I wonder if it's only in taiwan becuase the visto patents don't apply there??

theoretically it's true but practically Gigabyte is selling hardware to USA and it could be sued from USA thus.

Either way the cats out of the bag and MS must now deliver this feature to their other carriers and ODM's, OEM's etc. Business and consumer customers will no longer wait.

If MS is truly in violation of any Visto patents, they can buy them or drag it out until a reasonable settlement is reached.

yes! Now "the cat is out of the bag" and customers will no longer accept lack of A2DP and push direct in their phones. Moreover: customers will be purposefully waiting for appearance of such phones. After all it may happen that given phone will NOT be upgraded to AKU2. It IS possible. So why to risk if you can buy a phone with AKU2 pre-installed?

Vistos patents will not apply in Tiawan, However as far as I am aware there patents are registered in the US, UK and in Europe. A patent will apply to imported goods. So Microsoft are clearly not in defience of Vistos patent claims yet. Its clear however that Microsft have the update ready for distribution and since they are not distributing it in a patent protected region they clearly are being cautious and seeing how the Visto/smartner/seven cases go.

As far as Microsoft buying Visto out thats fair enough, though the net result will be the same they will have to have paid to use another companies intellectual property. Though remember I hear NTP are expecting 1 billion from RIM for use of its US patents. Thats a lot of money for a so called free update.

Microsoft have to start hiring people who have innovative ideas and come up with there own solution instead of hiring people from companies like Smartner and the result being similar possibly patent infringing solutions.

2 - 3 months ahead of schedule. I wonder why that is !!

It remains to be seen if Gigabyte / Microsoft get served with injunctions preventing sales of this phone.

Aaaaaugh! I still can't confirm if there is an English-based ROM for this device, can't seem to get a hold of anyone at Gigabyte, nor any resellers or resellers-to-be can get any confirmation either. I just want to move on if it's all in Taiwanese or Mandarin, or put my money down already.

Great news!

I received news from Sage at Kemplar.com who got a hold of his Asian contacts regarding the Gigabyte gSmart Phone:

I was afraid that we'd see another Asian device with all the bells and whistles many people would want, but slapped with a non-English ROM and interface that most of us here wouldn't be able to understand.

I'm thinking the device should be right around the corner, since all the press is buzzing about it and many are saying it's already "released." But, the fact that it will be available in English makes for yet another possible option to choose from, not just HTC and E-TEN anymore. Let's hope MMB can get his hands on a few of these!

Very cool, although a little bit vague. Anyway: in Europe the DVB-T digital television is standard and analog television is something of the past, so they may have some problems with marketing of this phone in Europe.. but probably for USA it would be more interesting...

anyway : I want it because it has FM radio, not because of TV.

AKU 2 contains the Messaging and Security Feature Pack for Windows Mobile 5 which provides the 'Direct Push' email capability. The other piece you need is Exchange SP2 which has been released. So this phone will be capable of "Push Email".
