Yeah but look at the Windows and Lindows case.

Windows is a dictionary word and Microsoft still managed to get Lindows to rename itself.

Well, Lindows was a very obvious play on th Windows name, with just an L in front of it. I never even considered that "BlackJack" could be a play on "BlackBerry" until I read about this. I always tought BlackJack was based on this device being black, and being all rectangular and very thin like a playing card.

Yes, but one was a fictitous word, the other was a dictonary word.

It is much harder to trademark a dictionary word versus a fictional one.

This is your usual tactics anyway, once someone sees their market being threatened they find some way of hampering the competitors.

yes, but it is whole world and RIM's claim is to "black" and not to whole "BlackBerry" word. It's like Microsoft would sue anybody who uses "win" in product name name because this is the first part of "WINdows" word!

It seems they're objecting to Black followed by another word.

I'm sure Apple would sue someone that created a product prefixed with i.

The case will be thus, RIM will have to prove that there is a reasonable chance that someone would be confused between blackberry and blackjack.

The same case sort of case happened between Yellow Wikis and Yellow Pages and they had to rename to OWikis.

Yes, but that's an accessory for one of their products.

I meant if the product was a competitor.

Eg. MP3 player called iPlayer.

It wouldn't take long to figure out the blackjack is a phone built by a professional, innovative Korean electronics company while the blackberry is an email device built by a litigation-seeking bunch of Canucks.

Kupe - I certainly wouldn't call Samsung "professional and innovative" for mirroring the design and functionality of RIM's products as well as having to use a name that is similar, hoping to capitalize on the BlackBerry's popularity....
