It is good that Windows Mobile powered Nokia phone is coming, because it looks like HTC is abusing its dominating market position (it manufactures over 80% of all Windows Mobile powered phone by now, including Sony ...

I disgree with your comments entirely. The basic fact is this is not a released piece of software and probably in the early stages of development. It's not uncommon for companies to get upset at "Not for release to public" information becoming public for a number of reasons. For one, people may take it as being final giving the company bad press before they even get it out the door. Second, they may have something in a "not to be released" piece of software or information where licensing still hasn't been worked out and the list goes on and on. In this case, they are will within their rights.

They are within their rights, but contacting Google to have action taken against MSMobiles is a last resort thing. Contacting MSMobiles would have been the right thing to do first (unless they did...)

I would be incredibly offended if the company I've been supporting so much on my blog went behind my back and took action against me like that.

HTC has NOT contacted msmobiles.com first but just contacted YouTube and YouTube sent threatening emails - so HTC behaved very badly here and indeed it is outrageous.

As I said: that video would be removed immediately if requested by HTC, but HTC behaved badly and damaged us through 3rd party.

I wonder who inside of HTC is responsible for this bad hehavior?

First HTC have every right to protect their intellectual property any way they feel is right. God knows how many software developers are out there already ripping of or trying to clone their user interface. This could lead to the disasterous position of somebody actually buying a patent on technology they developed or bring a clone of their product to market first.

However in the sme breath I have no faith in a company I feel mislead a lot of consumers into buying a poorly performing device. The HTC brand for me has been blackened to a degree that I will never purchase another HTC device again. This from a consumer who has purchased one HTC device every year sine the orange spv released in 2002.

Why should HTC approach MSMOBILES?

If I have an issue where I am not sure but I think I may have been wronged by someone then the best thing is for me to approach a judge and say:

"I am not a legal expert and I am not sure but I think 'such and such' may have done something wrong. I'm not saying that they have or have not but I would like it investigating please."
