Handango new contract - Handango becomes more evil

We were pretty critical of Handango here for several years already but now also some other news sources start to understand, that this company means no good for developers, big and small. It is not good that Microsoft supports Handango in any way too.

There are some tricks to get quite decent commission while selling software through Handango, and they involve doing business through registered business activity in USA combined with exclusivity deal whereas developer's website must link only to Handango for certain period of time, etc., but for most developers these tricks are not accessible.

Last September at the Handango summit, Handango said there was a new contract coming, but Andy, their CEO, claimed that royalties will not change. He lied. Now even using their commerce engine they lower the royalties (i.e. increase the commission). We are wondering why with the 100 million extra funding they received, and 40 more people they hired, no extra sales have been generated? Why they rip the developers off even stronger?

Recently Handango has forced upon developers a new contract where royalty percentage for most developers is lower (i.e. developer get even less money = higher commission):

To keep up with the growth and change in our industry, we must continually update and standardize our legal agreements. While the existing distribution agreement has received minor updates in the past, this agreement has been entirely revamped to enable us, as strategic partners, to share in the risk and reward of the many new business and market opportunities as they emerge.

Please find the new Content Distribution Agreement (CDA) attached. There is no action required on your part. The terms will go into effect March 15, 2008

Conclusion: Handango is a major mobile software store that is extremely bad for developers. There have been several enterprise deals with developers that Handango screwed up something fierce. Handango now is forcing developers to sign a "new" contract so that they can get better terms... so the only conclusion can be: if you are an end user, then never ever use Handango software store to purchase Windows Mobile software!!! Instead use developer's own software store (if there is one and it is not powered by Handango) or one of many other stores, please!
